These Terms of Service ("Terms") govern your access to and use of the ShynSmart website and services. By accessing or using our platform, you agree to be bound by these Terms.
1. Our Role as a Discovery Platform
ShynSmart operates as a proprietary jewelry discovery and aggregation platform. Our service consists of scanning, filtering, and curating publicly available listings from various third-party sellers, retailers, and marketplaces.
Crucially, ShynSmart does not:
- Sell or hold inventory of any jewelry items.
- Process payments or handle financial transactions for jewelry purchases.
- Manage shipping, fulfillment, or returns.
- Authenticate, appraise, or guarantee the physical quality of the items listed.
2. Third-Party Transactions
When you click on a deal or listing on ShynSmart, you will be redirected to the third-party seller's website to complete your transaction. Your contract for purchase is solely with that seller. We are not a party to that transaction and bear no liability for it.
3. Pricing and Availability
While our algorithms attempt to display the most accurate and up-to-date pricing, discounts, and availability, this information is subject to change at any time by the original seller. We do not guarantee the accuracy of prices, discounts, or stock levels displayed on ShynSmart. The final price and availability will be verified at the third-party seller's checkout.
4. Intellectual Property
The ShynSmart name, logo, proprietary algorithms, website design, and curated content are the intellectual property of ShynSmart and are protected by applicable copyright and trademark laws. Product images, brand names, and retail listings remain the property of their respective owners and are displayed under fair use for informational and referral purposes.
5. Limitation of Liability
To the maximum extent permitted by law, ShynSmart shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the platform; or (b) any conduct or content of any third party on the platform, including without limitation, any defamatory, offensive or illegal conduct of other users or third parties.
6. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, You agree to be bound by the revised terms.
